Action Ink-Jet
cartridges have been remanufactured under stringent quality control
standards, assuring performance
that equals or exceeds the original manufacturer.
Action Ink-Jet warrants each
cartridge to be free of defects in both material and workmanship. If
a Big Time Ink-Jet cartridge is found to be defective, Big Time
Ink-Jet will replace the cartridge or refund the full purchase
price.
Action Ink-Jet further warrants that
under operating conditions conforming to the specifications of the
manufacturer, our cartridges will not cause damage, abnormal wear,
or cause deterioration to any Ink-Jet, LaserJet, Fax or Copy
machine.
Action Ink-Jet also warrants that
when used as directed, the cartridge will not void any machine
warranties provided by the manufacturer. This warranty is dependent
upon the customer providing us with satisfactory evidence that the
machine failure was due to a defect in a Big Time Ink-Jet cartridge,
including a written statement on service company letterhead and the
return of subject cartridge.
Action Ink-Jet liability shall be
limited to replacement, repair, or reimbursement as provided above.
This warranty is exclusive and in lieu of all other warranties,
expressed or implied, including warranties of merchantability and
fitness for a particular purpose.
OTHER WARRANTY INFORMATION
Product Quality & Wrongly Voided Warranties
Have you been told your printer warranty has
been voided because you used alternative ink products, or have you
been threatened that your warranty will be voided if you use
alternative ink products? If so, read the following completely.
General Information
OEMs (Original Equipment of the Manufacturer)
are barred by current law from voiding warranties if customers
simply use alternative ink supplies. This practice violates both
Canadian and United States competition statutes forbidding a
practice know as “tied selling.” Tied selling can be explained like
this: Could Ford or GM void your warranty if you didn't use Ford or
GM gas? Of course not. Same with ink.
Original Manufacturer warranties
CANNOT be voided by use of remanufactured ink and toner
cartridges. Here is why:
Magnuson-Moss Warranty
Improvement Act
United States Code
Annotated
Title 15 Commerce and Trade
Chapter 50 Consumer Product Warranties 15 Section 2302
"(c) No warrantor of a consumer
product may condition his written or implied warranty of such
product on the consumer's using, in connection with such product,
any article or service (other than article or service provided
without charge under the terms of the warranty) which is identified
by brand, trade or corporate name; except that the prohibition of
this subsection may be waived by the commission if: 1) The
warrantor satisfies the Commission that the warranted product will
function properly only if the article or service so identified is
used in connection with the warranted product, and 2) the
Commission finds that such a waiver is in the public interest."
What this means to printer users: This means
that the manufacturer of the printer you are using cannot void the
warranty on your printer because you use a cartridge or refill kit
manufactured by someone other than the printer manufacturer. This
prohibition includes the use of compatible cartridges, clip-ons,
continuous feeding mechanisms, refill kits, ink, etc. For more
